Purpose of the privacy policy

MOVILIZATORIO S.A.S. and CORPORACIÓN MOVILIZATORIO, (hereinafter, “MOVILIZATORIO” or the “Company”), domiciled in Colombia, identified with the NIT 900884414 – 3 for S.A.S and 901.052.761-8 for CORPORACIÓN, domiciled in the city of Bogotá, will treat the personal data of its Petitioners, and of its Workers and Collaborators, in accordance with this policy. 

For this reason, and in compliance with its legal duties, MOVILIZATORIO, as the party responsible for the processing of personal data, hereby informs you of its Privacy Policy regarding the processing of personal data that it may collect in the course of its activities.

MOVILIZATORIO reserves the right to make, at any time, the modifications, updates or changes it deems appropriate in the terms of this Privacy Policy and, prior to its implementation, will request the corresponding authorizations when such changes imply the inclusion of new processing purposes or changes in the identity of the Data Controller.

2. Processing of Personal Data

The collection, processing and subsequent use of personal data by MOVILIZATORIO will be carried out in accordance with the provisions of Law 1581 of 2012, Decree 1074 of 2015 and other applicable regulations.

In this regard, it is necessary that all data subjects acknowledge that, in the course of their relationship with MOVILIZATORIO, they may be asked for personal data, such as their name, contact details, the history of petitions that the Petitioners sign or share, and certain demographic information. In addition, we store the IP address of the Petitioners in our databases.

It is likely that we will request information that may lead to know the political position or religious inclination of the Petitioners, in order to complete a particular request or survey. In no case will it be obligatory to disclose sensitive personal data.

In order for our network to continue to thrive, grow and be effective, we collect data from our members and our website users so that we can communicate with them and mobilize them more creatively and efficiently, create, promote and fund our campaigns, interact with policy makers, recipients of our campaigns and the media, and develop new and more effective ways to grow the MOVILIZATORIO network.

MOVILIZATORIO undertakes to observe and adopt any security measures necessary to ensure the confidentiality, secrecy and integrity of the personal data to which it has access, as well as to adopt any security measures required by laws and regulations aimed at preserving the secrecy, confidentiality and integrity in the processing of personal data.

MOVILIZATORIO will treat the personal data provided to it confidentially and undertakes to protect the privacy of all holders of the information.

3. Purpose of Personal Data Processing

MOVILIZATORIO informs that all personal data provided to it will be incorporated into the corresponding databases, which will be registered in the National Registry of Databases administered by the Superintendence of Industry and Commerce, if necessary.

The information provided by the Petitioners may be used for the following purposes:

a)          Facilitating Petitioners to support and sign a petition or survey, and getting the petition or survey into the hands of the intended recipient.

b)           Verify that the Petitioners are able to sign petitions.

c)           To provide the Petitioners with the services and information they have requested.

d)           Give the Petitioners the content they request.

e)          Facilitate, solicit and manage the participation of Petitioners in MOVILIZATORIO’s programs, events and activities.

f)          To know if the Petitioners would like to assist us in our work, campaigns and activities, for having a role that may be relevant to them.

g)          Process the donations from the Petitioners, or return the money requested by the recipients.

h)           Register Petitioners in MOBILIZATION.

i)          Send information about our work via email, phone, text message or social media messaging services. Because the fulfillment of our mission depends largely on who controls the government, our updates and opportunities may include information related to elections or political campaigns.

j)            Show who has participated in the campaign, showing their first name and the initial of their last name, their country, and the campaign in which they have participated.

k)          Involve Petitioners in campaigns, fundraising and special projects, provide them with information about MOVILIZATORIO’s work and facilitate the sharing of their initiatives on social networks.

l)            Notify decision makers, state entities, political candidates, news media and the general public when Petitioners sign a petition, send a message through our tools or join a petition.

m)         Create marketing campaigns, focused on promoting our work and involving the public in campaigns and individual requests.

n)           Check the identity of the Petitioners, and send them an e-mail to thank them for their signature.

o)          Answer your questions.

p)           To administer and improve the website and optimize our technology.

q)           Analyze your use of the site using tools that help us test the performance of the site’s content and functionality, understand site traffic patterns, and learn if there are any problems.

r)           Share the Company’s results with governmental or non-governmental entities and prepare studies and strategies to develop solidarity actions and promote other initiatives.

s)           Create campaigns focused on facilitating the development of the Company’s purpose, to advance initiatives aimed at promoting social, political, cultural or technical actions.

The personal information provided by MOVILIZATORIO’s Employees and Collaborators will be processed for the following purposes:

a)          To execute the contracts entered into with the holders of personal data.

b)           Contact the owners to send information related to the contractual and obligatory relationship.

c)           To manage, maintain, develop and control the existing contractual relationship between the parties, attend to their requests for information, as well as the management of their claims, processing their requests for termination of the contract and revocation of authorization for the processing of personal data.

d)           Manage queries made by the owners of the information.

e)          To know, store and process all the information provided by the owners in one or several databases, in the format it deems most convenient.

f)          Sort, catalog, classify, divide or separate the information provided by the owners.

g)          Register the information of the family group of the Company’s employees in order to comply with the duties established by law, as well as to make them participants in the welfare activities or benefits provided by the Company.

h)           To control access to the Company’s facilities.

i)           Verify, corroborate, check, validate, investigate or compare the information provided by the holders, with any information legitimately available to it.

In general, MOVILIZATORIO will process personal data for the following purposes:

a)          Send MOVILIZATORIO information, including information related to events, petitions, and any other matter that allows the development of MOVILIZATORIO’s purpose.

b)           Analyze, evaluate and generate statistical data on MOVILIZATORIO’s activity, as well as indicators, results, research on the needs of the Petitioners and/or any other consideration directly or indirectly related to the Company’s initiatives.

c)           Register the data of the owners of the information.

d)           Analyze, process, evaluate, treat or compare the information provided by the owners.

e)          To study, analyze, personalize and use the information provided by the holders for the follow-up, development and/or improvement, both individual and general, of the initiatives aimed at promoting social actions developed by the Company.

f)          Collect data for the fulfillment of the duties that, as Responsible for the information and personal data, correspond to the Company.

g)          To operate our website, maintain its security standards, and ensure that its content is presented in the most effective manner possible.

h)           To carry out audits and manage our systems and databases.

i)           Satisfy legal obligations, such as those related to the prevention of money laundering and financing of terrorism.

j)            To prevent fraud or misuse of our services.

In compliance with current regulations, MOVILIZATORIO may cross-reference your data with other databases under the responsibility of the Company, or public databases in order to comply with legal limitations related to the prevention of fraud and money laundering and terrorist financing activities. In this regard, the operator informs you that it may communicate information related to the activity of your account to the competent public agencies for the fight against fraud and money laundering and terrorist financing activities in accordance with the provisions of the regulations in force.

4. Rights of Personal Data Subjects

Personal data subjects have the rights recognized by the applicable regulations, which will be guaranteed by MOVILIZATORIO and are described below:

a)          Know, update and rectify your personal data.

b)           Request proof of the authorization granted.

c)           To be informed, upon request, of the treatment given to their personal data.

d)           File complaints before the Superintendence of Industry and Commerce for violations of applicable regulations.

e)          To revoke the authorization granted and result in the deletion of your personal data.

5. Information to the Data Subject on the Exercise of his or her Rights.

MOVILIZATORIO has designated the area of [⦁][1] as responsible for the processing of requests or claims related to the exercise of rights related to the protection of the rights of its Owners.

The Holder or its assignees may exercise their rights by sending an e-mail to hola@movilizatorio.org[2], including in the communication the reference “Personal Data Protection”. In any case, the communication addressed to the exercise of such rights, must include the following data of the holder and/or its successor(s): name, surname(s), and Citizenship Card number or any other document valid in law that proves their identity and the petition in which the request is made.

Inquiries

Inquiries will be answered within a maximum term of ten (10) business days from the date of receipt thereof. Such term shall be extended for a maximum term of five (5) additional business days, by means of a written communication to the Holder and/or its assignees in which the reasons for the delay and the date of response shall be informed.

Claims

Claims shall be dealt with within a maximum term of fifteen (15) business days from the date of receipt of the claim in its entirety, as described below.

Any claim must contain a description of the facts giving rise to the claim, the address of notification, and the documents to be asserted, as attachments to the claim. In the event that the claim is incomplete, MOVILIZATORIO will contact the Holder within five (5) business days following receipt of the claim so that the faults can be corrected within the following two (2) months. If the claim is not completed within such term, it will be considered as withdrawn.

The legend “claim in process” and a description of the claim will be added to the file or section corresponding to the Data Subject in the database involved within two (2) days following receipt of the claim in its entirety.

The term of response will be extended for a maximum term of eight (8) additional business days, by means of a written communication to the Data Subject and/or his/her assignees, informing the reasons for the delay and the date of response.

In accordance with Article 16 of Law 1581 of 2012, the Holder and/or its assignees may file complaints with the Superintendence of Industry and Commerce only after the claim has been made directly to MOVILIZATORIO and the response terms described in this section have expired or a response has been received from MOVILIZATORIO, whichever occurs first.

7. Transmissions and Transfers of Personal Data

MOVILIZATORIO may transmit and transfer the personal data for which it is Responsible to third parties. Such third parties may be located in Colombia, or in other countries that, in the opinion of the Superintendence of Industry and Commerce, guarantee an adequate level of protection of personal data, including the United States.

MOVILIZATORIO will send its surveys or requests to the corresponding addressees (to whom our surveys and requests are addressed), which may be government entities.

In the event that the Company is not able to carry out the processing by its own means, it may transmit the data collected to be processed by a third party, which will be in charge of the processing and must ensure appropriate conditions of confidentiality and security of the information transmitted for processing, in accordance with this Policy for the Processing of Personal Data.

MOVILIZATORIO may share with other entities that submit to the conditions of this Personal Data Processing Policy, the results of studies, analyses, customizations and uses carried out by the Company, as well as all the information and personal data provided by the owners.

All data processors shall act in accordance with MOVILIZATORIO’s personal data processing policies.
